Registration obligation

Closed-circuit biocidal products are mainly reserved for professional users. Buyers and users of these biocidal products must register online. Thanks to the mandatory registration system, the government has a good overview of the sale and use of hazardous biocidal products.

    Registration is mandatory

    Biocidal products that pose a high risk to health are classified as closed-circuit products. They may be poisonous, carcinogenic or toxic to reproduction. Therefore, these biocidal products are mainly reserved for professional users, according to the Royal Decree of 4 April 2019. Do you want to sell closed-circuit biocidal products? If so, you must register online (this is mandatory) and follow the safety precautions. Only biocidal products that have been authorised by the federal government may be sold on the Belgian market. The list of authorised biocidal products and the Certificate of Authorisation indicate whether it involves a closed-circuit product. 

    The law provides for one exception: sellers and users of certain rodenticides are not required to register. If such an exception is granted, it will be stated in Article 8 of the Certificate of Authorisation or Certificate of Registration.

    Why register?

    Thanks to the mandatory registration system, the government has a good overview of the sale and use of biocidal products in the various economic sectors. Sellers must annually declare which closed-circuit biocidal products they have sold, to whom and in what quantities. This allows the authorities to verify that closed-circuit biocidal products are only sold to professional users. The registered data is treated confidentially and only used within the framework of the national and European legislation on biocidal products. Therefore, sales figures are never published.

    Online registration

    Do you want to sell closed-circuit biocidal products? If so, you must register online.

    • To register as a seller, you must first create a personal account.
    • After that, you must register your company via the online registration tool.
    • Do not forget to declare, via the registration tool until 31 January each year, the quantity of biocidal products you have sold in the past year.

    Once registered, you can manage your account directly and independently. For example, you can add or remove contact persons for your company.

    As a registered seller, you have access to all useful product information, such as the Certificate of Authorisation, required personal protective equipment (PPE), hazard (H) and precautionary (P) statements, storage instructions and required precautions.

    Annual declaration of quantities sold

    Sellers of closed-circuit biocidal products must declare until 31 January each year which biocidal products they have sold in the past year, to whom and in what quantities. This can be done via the online registration tool. Each seller is responsible for declaring its transactions.

    Annual contribution

    In addition to the annual declaration in the context of the closed-circuit classification system, as a seller you must also make an annual declaration of the quantity of biocidal products you have sold, including both open and closed-circuit products. On the basis of this total quantity, the government calculates the annual contribution to be paid by you. You may submit your declaration via www.retributions.be.
